Abuse claim case settled against teacher, housemaster and scout master Mark Cory
A civil abuse claim has been settled against the estate of deceased teacher, housemaster and scout leader Mark Cory following a call for witness evidence earlier this year.
Posted on 09 August 2024
Mark Cory was a teacher at Rose Hill School and a teacher and housemaster at Aberdour School between 1953 and 1994. In addition to his roles in education, he was also a Scout master at the 5th Banstead Scout Troup between 1953 and 1967.
In 2018, Cory was subject to a fact-finding trial at Guildford Crown Court and was found to have committed 12 charges of child abuse by a jury but he was deemed physically unfit to stand trial and give evidence so no criminal punishment could be imposed.
Dino Nocivelli, abuse claims partner at law firm Leigh Day, was instructed by a man who alleged Cory abused them through his role as his teacher in the 1990s. Due to Cory being deceased and therefore unable to answer the claimant’s allegations of abuse, his legal team therefore had to prove the abuse took place and that a fair trial was still possible.
After collating evidence to show Cory was a serial abuser and that the client’s allegations had a similar factual basis as those for which he had been found to have committed, the legal team proceeded to arrange an appointment for a consultant psychiatrist to consider the impact of the abuse on the client’s life, to include on his education, earning capacity, relationships, substance use and therapy needs.
After a period of negotiation with the legal representatives of Cory’s estate, the legal team were able to reach a resolution and without the need for court proceedings.
Dino Nocivelli, abuse claims partner at Leigh Day, said:
“This case concluded within a matter of months of initially being instructed by our client and the lack of protracted litigation has undoubtedly meant that our client has been spared months of extended pain and suffering due to the case. We hope that the conclusion of this case will enable other survivors of Cory’s abuse, as well as other men who have suffered similar abuse, to disclose their abuse and to obtain the help and support that they deserve.”
If anyone has been affected by abuse by Cory in his personal capacity or through his teaching roles at Aberdour School or Rose Hill School, or though his role as a Scout master at the 5th Banstead Scout Troup then please do not hesitate to contact abuse claims partner Dino Nocivelli at Dnocivelli@leighday.co.uk or 020 7650 1397 to obtain legal advice.
