Former locomotive fitter receives substantial compensation following mesothelioma diagnosis

A former fitter who worked in a factory which manufactured locomotive engines has received a substantial sum in compensation after being diagnosed with mesothelioma.

Alan Hale instructed law firm Leigh Day in December 2016 in relation to a claim for his development of mesothelioma.
 
Mesothelioma is a fatal cancer which is only caused by being exposed to asbestos dust. It can develop decades after the initial exposure to asbestos.
 
Mr Hale believes he had been exposed to asbestos during the course of his employment at Vulcan Foundry Company Limited in Earlestown near Warrington between 1958 and 1967.  The factory used to manufacture locomotive engines.
 
Mr Hale was engaged in working as a fitter and carried out various duties during his apprenticeship.  He worked in areas around locomotive engines when asbestos was being sprayed inside carriages for insulation purposes.  
 
He believes he was also exposed to asbestos when he worked as a maintenance fitter at the foundry and was involved in carrying out repairs on lagged pipes which involved him having to strip asbestos lagging.
 
Solicitor Kevin Johnson, who specialises in mesothelioma claims, investigated Mr Hale’s claims and pursued his case very urgently due to his diagnosis.
 
While no formal admission of liability was made, just over five months from being instructed Mr Hale’s case was settled for a substantial sum.
 
Following the conclusion of the claim Mr Hale praised his legal team at Leigh Day. He said:

“I was pleased that we were able to resolve the claim for Mr Hale in a relatively quick timescale.  The compensation cannot change the devastating illness that he has suffered but will hopefully ensure that he has the means to obtain any support and equipment he requires and that he can remain in his own home and live independently for as long as possible.”
