Publication notice to join Biomet metal on metal hip litigation

29 March 2016

The High Court made a Group Litigation Order on 24 March 2016 in relation to a Group Action to be pursued by patients who received:

  1. A Biomet M2a Magnum hip replacement system; or

  2. A Biomet M2a-38mm hip replacement system

against Biomet UK Ltd the producer and importer of these prostheses for the purposes of section 1(2) of the Consumer Protection Act (1987) and Article 3 (1) of the Directive 85/374/EEC.

The Court has ordered that any individual who wishes to pursue such a claim may join the Group Action by being added to the Group Register of claims from 24 March 2016.

The Court has appointed Leigh Day (0800 689 7230) as the Claimants’ Lead Solicitors to the Group Action, in conjunction with:
However, Claimants may instruct any firm of solicitors to participate in the litigation. A list of solicitors instructed in these claims may be obtained from the Law Society (www.lawsociety.org.uk/ 0207 242 1222)

All individuals must have their claims investigated before they can be added to the Group Register so they need to come forward as soon as possible. The Court is likely to impose a cut-off date for joining the Group Action in the near future and the Court may decide that anyone who has not joined at that date may lose their opportunity to be part of the litigation.

If you are concerned about your Biomet M2a-38mm or Biomet M2a-Magnum hip prosthesis or any health issues associated with these implants you should seek medical advice.
