Supreme Court hearing on detention without due process

Four day Supreme Court hearing starts today

Supreme Court

1 February 2016

Statement from Leigh Day spokesperson:

"This Supreme Court hearing will hear arguments regarding the legal framework which applies when the UK detains people overseas, while assisting other states in maintaining security during periods of internal armed conflict.

"Last July, the Court of Appeal unanimously held that UK is not able to detain individuals without due legal process, which it found was lacking in Mr Mohammed's case.

"The Lord Justices rightly recognised the fundamental importance of the right to liberty, which requires a lawful authority for any detention and for core procedural safeguards to be afforded to a detainee, even in a situation of internal armed conflict."
