Compensation secured for cyclist following spinal injuries

A cyclist who suffered spinal fractures after being hit by a car driven by a negligent motorist has received a financial settlement.

In November 2018, 36-year-old British Cycling member Chris Summerill was cycling in Aberaman, Wales.

He was cycling on a road when a driver cut across his path and turned into a side road. Chris had no time to react and crashed into the car. He was thrown off his bike and landed on the road. 

At hospital Chris was told he had suffered spinal fractures and a neck injury. He was in hospital for nine days and had to wear a back brace for three months. 

As a keen athlete, Chris regularly took part in half marathons, long distance cycle races and triathlons before his injury. 

Chris was represented by Leigh Day specialist cycling team solicitor David Preston.

Following investigations, the driver’s insurer admitted liability the Leigh Day team obtained an early interim payment to pay for Chris’s private rehabilitation and treatment. After a lengthy recovery period, Chris improved his strength and was able to gradually return to running, cycling and swimming. 

Chris was unable to return to his work, teaching at a college, for around six months. He is also a self-employed singer who performed regularly in his local area but his injuries prevented him from performing for a long time and he lost money. 

After negotiations, Chris recently received a financial settlement to compensate him for his losses. 

Chris said:

“I’m really pleased my claim has been settled. The crash turned my life upside down. I couldn’t work for a long time and I worried about supporting my family. The settlement got back the money I lost and eased the pressure. My recovery took a long time but I’m really glad to be back on my bike.” 

David Preston said: 

“With hard work, Chris was able to get back to doing the things he enjoys most; cycling, running, and performing as a musician. We are pleased from him as we know how important this is to him. Now that a settlement has been agreed, Chris can try and put his injury behind him and focus on his future.”
