Jameson Road Landfill group claim

In September 2023, a new lease was granted by Wyre Council to TransWaste Recycling & Aggregates Ltd to reopen the Jameson Landfill in Fleetwood. The site had previously been run as a landfill from 2005 until 2017, which the previous operator, Suez, ceased operations due to capacity limitations and profitability issues.

Very shortly after the landfill was reopened, strong pungent rotten egg odours were reported by the local community. Complaints to the Environment Agency (EA) and council regarding the odours rose sharply in March 2024 and there has been extensive press coverage regarding the odours, community concerns, and pollution of the local land, nature reserve, and the River Wyre. In response to these concerns, the EA has installed a Mobile Monitoring Facility adjacent to the landfill to monitor specific odours, including Hydrogen Sulphide (H2S), Methane, and Sulphur Dioxide. The monitoring has evidenced odour levels, particularly H2S levels, in excess of international odour annoyance guidelines throughout the past few years.

The EA has also been undertaking drone monitoring of the site and frequent odour assessments and site visits. On 9 April 2024, the EA issued an enforcement notice requiring additional capping of the site. In May 2024, the EA issued a suspension notice requiring the EA to stop accepting new waste until odour control was completed. Repeated inspections by the EA showed non-compliance with the terms of the notice, which meant that the notice remained in place until July 2024. The EA issued a further suspension notice on 27 March 2025, requiring that no new waste was accepted on the site. This was lifted on 9 April 2025 after further works were carried out.

Members of the community have expressed ongoing concerns regarding the impact of the odours on the local environment and their daily lives, including their ability to enjoy and use their own properties. Leigh Day personal injury team partner, Michelle Victor and her team are investigating a potential group claim for those that may have suffered as a result of the pollution emitted from the Landfill.

What is the group claim about?

Michelle Victor’s team are investigating potential claims for compensation for the following losses:

Financial Losses – members of the community may have suffered financial losses due to the ongoing odour pollution. These may include:

  • Loss of business – hotels, bed and breakfasts, caravan and camping sites that have seen a reduction in bookings due to odour pollution
  • Reduction in the value of their property
  • The purchase of air purifiers or other aids to mask odours in the home

Loss of amenity – members of the community may also have been impacted in the following ways:

  • The inability to enjoy their garden / outdoor space
  • The inability to let fresh air into their house, and open their windows

Members of the community are also concerned regarding the impact on the local environment, including the River Wyre which runs adjacent to the landfill, the nature reserve directly north of the landfill, and the estuary / Irish Sea.

Who can join the claim?

  1. Those whose property rights are being affected: To join the claim for a breach of your property rights, you must have permanently owned/leased a property in the vicinity of the Jameson Road Landfill at some point from 2023 onwards and been impacted in some way by the odours.
