Jameson Road Landfill Group claim: odour pollution compensation
Members of the Fleetwood community have expressed ongoing concerns regarding the impact of the Jameson Road Landfill odours on the local environment and their daily lives, including their ability to enjoy and use their own properties.
Leigh Day’s personal injury department partner, Michelle Victor and her team are investigating a potential group claim for those that may have suffered as a result of the environmental impact from the Landfill.
Members of the community are also concerned about the impact on the local environment, including the River Wye which runs adjacent to the landfill, the nature reserve directly north of the landfill, and the estuary / Irish Sea.
What is the group claim for the Jameson Road landfill pollution about?
Michelle Victor’s team are investigating a potential group claim for odour pollution compensation for the following:Financial Losses – members of the Fleetwood community may have suffered financial losses due to the ongoing landfill odour pollution. These could include the purchase of air purifiers or other aids to mask odours in the home.
Loss of amenity – members of the community may also have been impacted in the following ways:
- The inability to enjoy their garden or other outdoor spaces
- The inability to let fresh air into their house and open their windows
Who can join the group claim?
If you have sustained financial losses or suffered from a loss of amenity because of the odours emitted from the landfill, you may be eligible to claim compensation.
To join the claim for a breach of your property rights, you must have permanently owned or leased a property in the vicinity of the Jameson Road Landfill from 2023 onwards and have been impacted in some way by the odours.

Jameson Landfill legal action background
In September 2023, a new lease was granted by Wyre Council to TransWaste Recycling & Aggregates Ltd to reopen the Jameson Landfill in Fleetwood. The site had previously been run as a landfill from 2005 until 2017, which the previous operator, Suez, ceased operations due to capacity limitations and profitability issues.
Very shortly after the landfill was reopened, strong pungent rotten egg odours were reported by the local community. Complaints to the Environment Agency (EA) and council regarding the odours rose sharply in March 2024 and there has been extensive press coverage regarding the odours, community concerns, and pollution of the local land, nature reserve, and the River Wye.
In response to these concerns, the EA has installed a Mobile Monitoring Facility adjacent to the landfill to monitor specific odours, including Hydrogen Sulphide (H2S), Methane, and Sulphur Dioxide. The monitoring has evidenced odour levels, particularly H2S levels, in excess of the international odour annoyance guidelines throughout the past few years.
The EA has also been undertaking drone monitoring, site visits and frequent odour assessments. On 9 April 2024, the EA issued an enforcement notice requiring additional capping of the site. In May 2024, the EA issued a suspension notice requiring the EA to stop accepting new waste until the odour control was completed. Repeated inspections by the EA showed non-compliance with the terms of the notice, which meant it remained in place until July 2024.
The EA issued a further suspension notice on 27 March 2025, requiring no new waste be accepted on the site. This was lifted on 9 April 2025 after further works were carried out.
