High Court to hear key stage in claim over alleged faulty Jaguar Land Rover diesel particulate filters

The High Court will hear an application for a Group Litigation Order (GLO) made on behalf of thousands of claimants over alleged defects with their diesel Jaguar Land Rover (JLR) vehicles.

Posted on 29 October 2024

The alleged issues relate to defective diesel particulate filters (DPF) – a filtration device fitted to diesel car exhausts in order to capture soot and other pollutants.

The hearing will determine how the claimants’ cases will be managed together, so that the claims being brought against JLR can progress as efficiently as possible. It is due to be heard by the Senior Master in the High Court on Wednesday 30 October 2024 starting at 10.30am.

Leigh Day is currently representing more than 14,000 people in this claim. Milberg LLP are also representing tens of thousands of claimants and are working with Leigh Day to ensure effective management of the claim.

It is understood that defects in JLR vehicles purchased or leased between 2015 and 2023 have resulted in them being unable to burn off enough soot from the DPF, leading to the system becoming prematurely clogged.

This can cause a number of problems including loss of power and engine damage, as well as worsening the environmental performance of the car, meaning it is less likely to meet advertised environmental standards.

The group claim could be worth thousands of pounds in compensation for each claimant depending on the price paid for the vehicle, repair or service costs, and the depreciation of the vehicle’s value.

Vehicles included in the claim are:

  • Land Rover Discovery (L462)
  • Land Rover Discovery Sport (L550)
  • Land Rover Velar (L560)
  • Range Rover (L405)
  • Range Rover Sport (L494)
  • Range Rover Evoque (L538 and L551)
  • Jaguar E-Pace (X540)
  • Jaguar F-Pace (X761)
  • Jaguar XE (X760)
  • Jaguar XF (X260)

Leigh Day partner Oliver Holland said:

“We have thousands of clients who say they have been experiencing problems with their Jaguar and Land Rover vehicles, with our investigations leading us to believe that defective diesel particulate filter systems may be the cause of this. These issues can affect the performance of the vehicle and result in the owner having to pay for repairs, as well as lowering the resale value of their car. This hearing will decide whether a Group Litigation Order is made, which will enable us to manage this claim effectively and to progress it as swiftly as possible on behalf of our clients.”
