Serious head injury at work results in six-figure payout

A Polish man has received compensation after being seriously injured at work

Mr D suffered a severe head injury

We represent Mr D, a Polish national, who was living and working the UK when he sustained a serious injury at work. Mr D was injured when pallets containing steel frames fell on him.  This happened because his employers had not adopted a safe method of stacking the pallets and had offered no health and safety training to him. The claim was brought against Mr D’s former employers. Liability was admitted at a relatively early stage.

Mr D sustained a very serious head injury.  He suffered from both neurological, ENT and psychological symptoms.  Following his return to Poland shortly after the accident, we were able to secure a number of interim payments to enable Mr D to undergo a course of treatment in Poland. 

Given the complex nature of Mr D’s injuries, it was necessary for us to obtain neurological, ENT and psychiatric evidence and arrangements were made for Mr D to fly to the UK to undergo a series of appointments with UK based experts, with those expenses being funded by way of interim payments.

Mr D‘s claim was complex.  The seriousness of the head injury impacted on his ability to work for the foreseeable future.  Mr D’s loss of earnings claim was advanced on the basis that but for his accident, he would have remained living and working in the UK earning considerably in excess of the salary that he could have expected had he returned to Poland.

It was necessary to issue court proceedings.  The case was successfully concluded by way of negotiation in the sum of £250,000. The matter was dealt with by our dedicated Polish injury team.
