Local resident challenges opening of new GP led health centre on Hampstead Road

Richard Stein and Rosa Curling have been instructed by Camden resident Willibald Davies. Mr Davies is concerned NHS Camden appears to have decided to open a new GP led health centre in Stephenson House, Hampstead Road without properly consulting and involving the public.

Leigh Day has advised Mr Davies that this is unlawful. The NHS Act 2006 requires NHS bodies to “consult” or “involve” the public about proposed changes to health services, ensuring that users’ views are taken into account before decisions are made.

A document, Primary and Urgent Care Strategy: Your views, Your voice circulated by NHS Camden claims to have informed local residents about it’s plans to open a new GP practice in 2007. However, Mr Davies has no recollection of any such communication. The document goes on to request comment from the public on the proposal. However, at the same time, it is clear that NHS Camden is already taking steps to set up the Centre, rendering the “consultation” meaningless.

Leigh Day has written to NHS Camden requesting that it withdraw the decision to (1) open the proposed GP led health centre and (2) award the contract to Care UK until a full public consultation has taken place.

Richard Stein said the following:

”The Trust is providing a health service for the public and acting on the public's behalf. It is their legal duty to consider the public's views when proposing changes to NHS services and such consideration does not appear to have taken place in relation to this centre. Unless NHS Camden confirms it will withdraw its decision, we will have no option but to make an application to the court."
