Bob Unstead’s widow and young son receive compensation after his death from mesothelioma

Asbestos lawyers secure settlement for former Kitsons worker

Tracey Unstead and her son have received compensation following the death of her husband, Bob, aged 62, from mesothelioma in 2015.

Specialist asbestos lawyer at Leigh Day, Daniel Easton, was contacted by Bob in early 2015 following his diagnosis. 

Although Daniel acted quickly to issue court proceedings and bring a claim against his former employer, Kitsons, Bob succumbed to his illness in September. Leigh Day then continued the claim for his widow and young son.

Insulation contractors Kitsons, a company with branches all over the UK, denied that they used asbestos during Bob’s employment and fought hard against the claim. 

Daniel gathered supporting witness evidence from across the country including from an expert engineer.  A trial was due to take place in October 2017.

Bob had run his own business, an asbestos surveying and removals company, which meant that Daniel also needed to get detailed information about his work, and instruct an independent accountant help work out how much Bob’s claim was worth.

He was based in the defendant’s Exeter office and worked in numerous buildings including schools across Devon and Cornwall.

Leigh Day instructed two very experienced industrial disease claim barristers, to ensure that Bob and his family had the very best representation possible.

Daniel was able to resolve the claim at a settlement meeting, without an admission of liability, avoiding the need to go to trial.

Mesothelioma is an aggressive form of cancer which is usually only caused by exposure to asbestos.  About 2,500 people die from mesothelioma every year.  It can take many years, usually decades after exposure, to manifest.
