Brazilian cyclist awarded compensation after being hit by a truck in London

A Brazilian cyclist seriously injured whilst cycling through Central London has been awarded a five figure sum after a partial admission of liability from the defendant’s insurer.

The Brazilian man was on holiday visiting a friend when he sustained serious injuries to both legs in a road traffic collision which occurred whilst he was cycling through Parliament Square, a route through the City he had taken many times previously.

He was knocked off his bike by a cement truck, which then ran over both of his legs. He suffered multiple fractures to his right leg and foot and a severe degloving injury to his left leg.

He was hospitalised in the UK for six weeks and underwent further surgery following his eventual return to Brazil. He has been left with permanent and severe scarring. In addition to his physical injuries he also sustained psychiatric injury.

Liability was initially denied but eventually admitted in part only. Lawyers at Leigh Day who deal with incidents in countries all over the world, instructed medico-legal experts in the UK and in Brazil.

Christine Tallon from the personal injury team at Leigh Day said:

“This was a traumatic event made worse by the fact that the Claimant spoke only a few words of English and therefore had little understanding of what was happening to him or of the surgery that was provided and planned.

“Following discharge he was not entitled to recommended physiotherapy treatment under the NHS and was therefore left without medical support until certified as fit to fly home. “It was undoubtedly a very difficult time for him and the residual scarring will be a permanent reminder of this.“
