Emmalene is a solicitor in the clinical negligence team. She joined Leigh Day as a solicitor in November 2004.
Since joining Leigh Day, Emmalene has assisted head of department,
Russell Levy and partner,
Nicola Wainwright with their complex and high value cases whilst developing her own clinical negligence caseload. She continues to work with Nicola on cases such as
child birth injuries including
cerebral palsy and together they have secured an admission of liability and an interim payment of £900,000 in their most recent case.
Emmalene handles a wide range of cases, but has particular interest in claims involving the delay and diagnosis of appendicitis,
maternal birth injuries such as vesico vaginal fistulas as well as other
gynaecological injuries, shoulder dystocia and failure to diagnose and treat tuberculosis. Emmalene has recently developed a practice in cases involving the failure to treat and diagnose leishmaniasis, a disease spread by the bite of a sand fly.
Emmalene has previously been involved in drafting and representing the firm’s interest on the Bereavement Charter as part of recent Coroner Reforms.
Emmalene’s recent settlements/admissions include:
- Obtaining an admission of liability and compensation for a mother and father following the death of their five month son at Barnet Hospital who died less than 36 hours after being admitted for monitoring and weight gain after a failure by Barnet to recognise his deterioration and transfer him back to a paediatric cardiac unit.
- Securing a six figure sum and apology for a young woman who suffered a delay in diagnosing and treating appendix resulting in significant injury including peritonitis, bowel perforation leading to an abscess, a stormy post-operative recovery, an incisional hernia, cosmetic problems and fertility problems arising out of additional adhesions as a consequence of the delay in treatment of peritonitis.
- Admission of liability following the death of a 46 year old woman from tuberculosis in a case where her GPs failed to refer and treat on going symptoms for a period of 12 months.
