Cyclist who was knocked out in collision compensated

British Cycling member David Fleming has successfully recovered damages following a road traffic collision that occurred on 9 November 2009 as he was cycling around a roundabout at the junction of Aldwick Road/Lower Bognor Road, Bognor Regis.

The collision happened as David went past the first exit (Lower Bognor Road) and a motorist drove onto the roundabout without stopping and into David’s bicycle.  David was thrown from his bike onto the road and lost consciousness. Paramedics and police officers were called to the scene and David was taken by ambulance to Royal West Sussex Hospital where he remained for five days.

As a result of the collision, David sustained various painful injuries including concussion, extensive bruising to the left hand side of his body and three fractured ribs. His bicycle and cycling equipment were also damaged. David was unable to cycle for four months while he was recuperating from his injuries and the enjoyment of his cycling holiday in May 2010 was significantly impaired.

The motorist’s insurers accepted liability for the accident. Following disclosure of medical and witness evidence, David’s damages claim was agreed without the need for Court proceedings. He received compensation for his injuries, loss of amenity, damaged bicycle and cycling helmet, travel expenses, medication costs and care and assistance.

David was represented by Anna Hart in Leigh Day & Co’s Cycling and Sports Injuries Team and his claim was supported and funded by British Cycling.
