The Equal Pay Act prohibits less favourable treatment of male and female workers (including women who are pregnant or on maternity leave) in relation to pay and other contractual terms (including, for example, holiday pay, pensions, other benefits) where a woman and man, in the same employment, are doing:
  • like work,
  • work rated as equivalent under a job evaluation scheme,
  • work of equal value. 
     

The Equality and Human Rights Commission has a Code of Practice.

The employer has a defence if the difference in pay or contractual terms is genuinely due to a material factor other than sex. This may be where, for example, one employee is paid more to protect his pay following a change in his job.
