Rebecca Smith at Leigh Day & Co has successfully concluded a case on behalf of Mr Gregorz Stolarczyk who was injured at work, on 23 March 2005.

Mr Stolarczyk approached Leigh Day & Co having achieved no success with his former solicitors.  As this time there was only an offer of 25% of the value of the claim.  There had been no investigation whatsoever in relation to quantum.

The accident occurred whilst Mr Stolarczyk was attaching tiles onto the side of a house. He set-up a makeshift scaffold.  There was no suitable scaffolding available on the site and the method used by Mr Stolarczyk was approved by his employers.   Additionally, there was no training given and there was no-one to supervise the work being undertaken. Mr Stolarczyk climbed onto the scaffold and it suddenly gave way.

Mr Stolarczyk sustained a serious fracture to his leg as a result of the fall.  The injury required two separate surgical operations and immobilisation of his leg periodically over the following two-year period. Additionally as a result of complications with the injury, Mr Stolarczyk was unable to work for approximately two years.  He has now been able to return to work. 

Medical evidence was obtained and disclosed by Leigh Day & Co.  Liability remained in dispute.  Having offered only 25%, by negotiation, settlement was reached on the basis of 75% going to the client.  Leigh Day & Co managed to secure £135,000 by way of compensation.
