Pedestrian injured on crossing receives compensation

Ms Matthew has successfully concluded her claim for personal injury compensation following a road traffic incident on 18 August 2005.
Ms Matthew was injured whilst crossing the Bath Road in Hounslow. She was using a pedestrian crossing. The lights had turned to green allowing pedestrians to cross. She was then hit by the Defendant’s car which was reversing back onto the pedestrian crossing.
As a result of the collision, Ms Matthew sustained a serious fracture of the hip. The injury meant that she was unable to work for a significant period of time and had to be cared for by her husband and family.
Liability was an issue from the outset with the insurers denying liability throughout. As a result, rather than being in a position to resolve this case amicably, we were forced in to a position of having to investigate liability, track down witnesses, and obtain an expert accident investigation report.
In spite of the denial of liability, the insurers originally made an offer to settle the claim in March 2007 for £43,000. Subsequently, that was reduced to £25,000 in November 2007, arguing that our client was an author of her own misfortune.
We maintained our position on liability, and were prepared to take the matter to trial if it had been necessary. Following the issue and service of proceedings, settlement was finally agreed in the sum of £142,500. Ms Matthew was represented by Rebecca Smith in Leigh Day & Co’s Personal Injury Department.
