Olive Lewin has successfully acted on behalf of a client in a claim against North West London Hospitals NHS Trust for the alleged negligent treatment afforded to him during his birth in July 1998 at Northwick Park Hospital.

During her pregnancy, our client’s mother was diagnosed with gestational diabetes.  This is a condition that can lead to increased complications for both mother and baby during pregnancy.  Consequently the pregnancy was considered to be high risk.  During labour the fetal heart rate was monitored by CTG.  The CTG was abnormal for a lengthy period of time and a decision to deliver by emergency caesarean section was not made when it should have been. Consequently, when our client was eventually delivered by caesarean section he was in a very poor condition and was very ill and was an inpatient for several weeks on the neonatal unit. 

Despite his extensive injuries, our client has made remarkable progress, often surprising medical experts who examined him during the course of the case.  Medical experts have said, that given his poor condition at birth, they would have expected our client to suffer from severe cerebral palsy.  However, he is able to run, swim, play various sports and computer games and he attends a mainstream school.  He does however suffer from a specific language disorder that causes him some difficulty in understanding and formulating spoken language.  This is likely to disadvantage him in adult life.

The value of our client’s claim was significantly affected by the remarkable progress he had made and settlement was agreed at £275,000.
