Extension of the right to request flexible working

As from 6 April 2009 employees with parental responsibility, who have been employed for 26 weeks, can request flexible working for children up to the age of 17. Previously, requests could only be made in respect of children under six or, if disabled, 18. Flexible working includes part-time working, varying working hours or home working.
There is no obligation on employers to grant the employee’s request, but only to follow a prescribed procedure. However, an unjustified refusal may be indirect sex discrimination and lead to substantial compensation.
Hot tip: many employees do not realise that they have legal expenses insurance which would cover such a claim and they have the right to choose their own solicitor.
