Road and pavement accidents
Roads and pavements are usually maintained by the local highways authority. These authorities have a responsibility to ensure that the roads and pavements are properly maintained in a reasonable condition. However, the fact that a tripping or slipping incident has occurred as the result of an uneven paving slab, pothole etc, does not mean that a claim for compensation will necessarily succeed. The Courts have been careful to explain the extent of the highways authorities' legal responsibility to prevent local councils from effectively insuring all road users who suffer injuries from minor defects. Road surfaces will never be free of all hazards and road users, including pedestrians, are required to take reasonable care to avoid obvious defects.
It is important to take photos and measurements of the defect, in case the area is repaired before your claim has been reported. These will also help us in advising whether your claim has reasonable prospects of success.
