Mesothelioma settlement

7 March 2006

A former carpenter has recovered £225,000 following his diagnosis with mesothelioma, a fatal form of lung cancer caused by asbestos.  He was employed by the Home Office to undertake repairs and renovations in a Youth Custody Centre and in the course of his duties had to use asbestos boards when constructing buildings.  He was exposed to deadly asbestos fibres from the boards when he cut and drilled them and was not provided with any form of protective equipment or proper safety procedures.

He was represented by Leigh Day & Co specialist asbestos solicitor, Daniel Easton, who obtained a preliminary payment within 5 months and a final settlement within 9 months of initial instruction.

Daniel comments that:

"Although the damages in these claims only go a little way to compensating the victims for the pain and suffering and the devastation to their families, we do hope that it provides some financial relief in such tragic circumstances.  Mesothelioma is a terrible disease and it is important that those businesses and bodies who knowingly exposed people to asbestos are now brought to justice”.

Action Mesothelioma Day

Leigh Day & Co was recently pleased to be able to support Action Mesothelioma Day which was held on 27the February.  During the day a charter was presented to 10 Downing Street.  The charter argues for more and better rights for sufferers, calls upon the Government to have mesothelioma made a national priority, ensure the Health and Safety Executive vigorously enforce existing regulations on asbestos and calls for employers to safeguard all employees and identify all asbestos in their properties and ensure its safe removal.  It also calls for a national strategy from the NHS on the treatment for mesothelioma; calls for medical research and recognises the importance of mesothelioma sufferers obtaining expert legal advice.
