Debbie Chandler was awarded a lump sum and annual payments in November 2004 after being left an almost
complete amnesiac following an
undiagnosed subarachnoid haemorrage.
Barking hospital
Debbie was admitted to Barking hospital who failed to diagnose a
subarachnoid haemorrage. Whilst she has mostly physically recovered, she has been left an almost complete
amnesiac. She cannot remember anything in her life from one second to the next, although she has residual memory that does allow her to recognize her parents and friends. However Debbie, who is in her early thirties, cannot get dressed, choose clothes or manage her personal hygiene without continual reminders. She needs a 24-hour carer to ensure her safety and a degree of independence.
Periodic payments
Barking, Havering and Redbridge Hospitals NHS Trust admitted liability for breach of duty and causation and Debbie was awarded a lump sum of £1.05 million + £114,000.00 per year for life under the periodical payments scheme. All monies will be handled by her Receiver and the Court of Protection.
Indpendent living
Frances Swaine, of the Clinical negligence department who acted for Debbie said:
“Despite the tragic circumstances of this case, because the NHSLA were able to consider and implement a system of periodical payments, I can rest assured that Debbie has the opportunity of financial security, and therefore independent living, for the rest of her natural life."
