Birth injury specialist lawyer settles case for bereaved parents

Clinical negligence partner Suzanne White has recently settled a case for her client.

Birth injury claims specialist Suzanne White recently successfully concluded a case on behalf of her client, Emma Tidy whose baby died soon after being born. 

During the evening of 30th December 2009 Emma attended Queen Mary’s Hospital in Sidcup with cramp-like pains.   She was 28 weeks pregnant. A CTG ( reading of the baby’s heart beat) at 22.43 showed there should have been concerns about the baby, but no action was taken. Emma underwent an emergency caesarean section and her baby was born in very poor condition at 2.50 on 31st December. The baby was transferred to Chelsea and Westminster Hospital where she sadly died on 2nd January 2010.

On behalf of her client Suzanne argued that there was a breach of duty by the hospital in that:

  • There was a clear failure to note the CTG trace was abnormal, showing concerning signs when Emma was admitted;
  • The staff failed to understand the urgency of the situation and communicate that concern to other staff members
  • There was a delay in performing the caesarean section which should have been performed by 01.45, if it had been carried out earlier, this would have meant that the baby would have survived.

Suzanne’s client and her partner were left severely traumatised, and devastated by the death of their baby girl and the settlement which has been secured on their behalf includes an element of compensation to recognise this.
