Sexual abuse by care worker
Maria acted for Y, a particularly vulnerable client with mental health problems in a successful claim for personal injuries against an NHS Trust after she was sexually abused by her care worker while she was receiving in-patient medical care and treatment from the Trust.
Following the sexual abuse that Y suffered at the hands of her care worker she developed post-traumatic stress disorder, along with the worsening of her existing conditions which included anorexia nervosa, depression and anxiety. The care worker with responsibility for Y took advantage of this extremely vulnerable client and sexually abused her. Following a criminal trial, the care worker pleaded guilty to unlawful sexual intercourse with a female patient and received 12 months imprisonment, suspended for two years.
Court proceedings for a civil claim were issued and served. In the course of the case, negotiations were entered into to try to reach a settlement without further recourse to the court and the claim was settled for a significant six-figure sum.
