Cyclist hit by overtaking motorist wins damages

British Cycling member Andrew Williams has recovered damages following a road traffic collision which happened on the 15th February 2009 as he was cycling along Dinas Road, Porth.

Andrew was thrown from his bike as a result of a motorist overtaking him before a junction on his left, and then cutting in directly across his path.  As a result of the driver’s negligence actions he collided with Andrew, knocking him from his bicycle.

Andrew suffered fractured ribs and bruising to his left knee and elbow.  His bike and clothing were also damaged.

After receiving a copy of the police accident report in which the motorist accepted responsibility for the collision to the attending police officer, the driver’s insurers accepted liability for the incident.

Medical evidence was served on the insurers of the driver together with a settlement offer after which we were able to negotiate a settlement for Andrew.  Andrew was represented by Penny Knight and Philip Hunter in the cycling and sports injuries team at Leigh Day & Co and his claim was funded and supported throughout by British Cycling.
