British Triathlon member wins damages

BTA member Derek Austin has successfully recovered damages after a road traffic collision which happened on 20th October 2009 as he was cycling to work along a marked cycle lane on Stroud Road, Gloucester.

As he was cycling a car’s passenger door opened into Derek’s path knocking him from his bicycle.  He suffered multiple soft tissue injuries and lacerations to his fingers, hand and elbow. 

Derek made a rapid recovery from his injuries and liability for the collision was admitted by the defendant.  Derek received damages for his injuries, damage to his bicycle, clothing and wedding ring without having to undergo a medical assessment.

Philip Hunter, a member of Leigh Day’s cycling and sports injuries team represented Derek whose claim was supported and funded by British Triathlon.
