British Triathlon member Jennifer Miller has recovered damages following a road traffic collision which occurred on the 14 March 2009 as she was cycling along White Lane in Harmston.
Jennifer was thrown from her bike as a result of a lorry overtaking her bike too closely. As a result of the driver’s negligent actions Jennifer was knocked unconscious and has no recollection of the accident. Jennifer suffered very severe injuries including nine broken ribs, a punctured lung, broken right shoulder blade, punctured diaphragm and internal bleeding. Her bike and clothing were also damaged.
Liability was initially disputed by the lorry driver’s insurance company on the basis that Jennifer had lost control of her bicycle and hit the side of the lorry. Following the disclosure of the police report, and by obtaining a detailed locus report, Leigh Day was able to resolve liability without the need for court proceedings.
Jennifer was quickly awarded a substantial settlement once liability had been resolved. She was represented by Penny Knight and Robert Goodship in Leigh Day & Co’s cycling and sports injuries team.
Jennifer’s claim was supported and funded by the British Triathlon Association. She said:
“I cannot thank Robert, Penny and the team enough for all the help and support they have given me through this process. I always felt like they were doing everything they could for me, and I always knew exactly what was going on. They made dealing with the repercussions of the ordeal stress free."
