London bombing award re-assessed

10 September 2009

Daniel Easton, a partner in the personal injury team at Leigh Day & Co, represents London bombing victim Australian Jodi Ayre. Jodi was travelling on the No.30 bus that was blown apart at Tavistock Square on July 7 2005. She suffered from a burst eardrum, hearing loss and tinnitus, but on returning to Australia, was diagnosed with post-traumatic stress syndrome, something she describes as “survivor’s guilt”. Daniel Easton, has now successfully applied for a review of a Criminal Injury Compensation Authority (CICA) award that was originally granted to Jodi in 2007.

When Jodi again approached us in 2008 due to a recurrence of her psychological injuries and the severity of her ongoing tinnitus, we successfully applied to the CICA to re-open Jodi's case and re-consider the compensation she was originally awarded.

We obtained further medical evidence showing that Jodi was continuing to suffer the after-effects of the bombings and that it continued to have a major impact on her life, particularly her work. Through this evidence were able to secure almost double the original damages that she was awarded.

Leigh Day & Co acted for Jodi on a pro bono basis under a Law Society Scheme to provide assistance to victims of the London bombings.

Partner, Daniel Easton, who has acted for a number of London bombings victims said:

"The attacks on London on 7 July 2005 had a devastating effect on the City and its residents and the Criminal Injuries Compensation Authority awards have been key aspects in helping people to deal with the financial pressures of the impact their injuries have on their lives. It is unsurprising that some years after the event, victims are continuing to feel the effects and will do so for many years to come. Whilst the compensation will never eradicate the impact of the terrorist atrocities, it may help alleviate some of the stresses associated with the injuries".
