Pothole cause of injuries

British Cycling member Martin Beckingham has received damages in respect of injuries suffered as a result of an accident involving a pothole on the 4th of February 2007 as he was cycling through Tilford Village with a group of cyclists.

Surrey County Council denied liability on the grounds that Tilford Road is subject to inspections on a three monthly basis and on the last inspection prior to Martin’s accident revealed no defects.

Prior to the accident work had been carried out on Tilford Road by a contractor. Surrey County Council claim the trench was the responsibility of BT.The defect measured approximately 30 cm square and 40 cm in depth. It further transpired that the trench was the responsibility of Skanska who in turn confirmed that their contractors, CDL Construction, were responsible for the defect.CDL Construction agreed to deal with Martin’s claim on a without prejudice basis and following receipt of medical evidence, the Defendant’s insurers accepted Martin’s settlement proposal.
Martin sustained injuries to the left side of his face, including a broken tooth and crown resulting in dental work as a result of the accident as well as various cuts and bruises to his face.Martin’s bicycle also sustained damage.
