The
Baha Mousa Inquiry has today published a provisional list of the issues on which the Inquiry’s investigations will focus. The Inquiry is chaired by the Rt. Hon. Sir William Gage.
The list of issues fleshes out what is to be considered under the four modules of the Inquiry, which are:
- The history of “conditioning techniques” - from the time of internment in Northern Ireland up to the invasion of Iraq in March 2003;
- The circumstances of the arrest and detention of Baha Mousa and the other detainees in September 2003, including what happened to them and who was involved;
- Training and guidance on detention and chain of command issues;
- The future – what has happened since 2003 and appropriate recommendations for the future
Further issues which are within the terms of reference of the Inquiry may be added to the provisional list of issues during the course of the Inquiry.
The Inquiry Chair has also announced that the first Directions Hearing will be held on Wednesday 3 December 2008 when he will give directions to the lawyers representing the Inquiry’s participants including Leigh Day & Co, who are jointly representing the victims with Public Interest Lawyers.
These will include directions about the provision of evidence, the process for determining which witnesses are to be called to give oral evidence, and the timetable for the Inquiry. The issue of reporting restrictions will also be considered at this hearing.
A second Directions Hearing will be held on Wednesday 21 January and Thursday 22 January 2009.
