British Cycling member, Thomas Robbins, has successfully concluded a claim for damages via the
Motor Insurers' Bureau (MIB) for a road traffic incident which occurred on the 14th July 2005.
At the time of the incident Thomas was out on a training ride, cycling along the A417 when he was knocked off his bike by a motorist who drove alongside his bike, shouting abuse and who proceeded to cut him up. Afterwards the motorist drove off.
As a result of this shocking incident Thomas suffered a serious fracture to his wrist, damage to his bike and other consequential losses and expenses. The episode was reported to the police but unfortunately they were unable to trace the vehicle or driver involved.
Thomas pursued a damages claim via the MIB under the Untraced Drivers Agreement which is an agreement set up with the Department of Transport for the purposes of compensating victims of untraced drivers.
Following investigations the MIB accepted liability for Thomas's accident and made a gratuitous payment to compensate him for the injuries and consequential losses he suffered.
Thomas was represented by
Anna Hart in the cycling and sports injuries team at Leigh Day & Co and his claim was supported and funded by British Cycling.
Anna has also acted for British Cycling member, Daryl Gannon, who has recovered compensation following a road traffic collision in August 2007. He was in collision with a car which drove into the back of him at a traffic light junction. Fortunately, Daryl only sustained minor injuries and has made a full recovery.
