Personal injury award for British Cycling member

British Cycling member Dr Philip Marren has successfully concluded his claim for personal injury compensation after from a road traffic collision which occurred on 4 February 2007 as he was cycling to meet up with the Sherwood Cycling Club for a Sunday club run.

The collision happened as Philip was riding in a southerly direction along Westdale Lane East and a car which was travelling in the opposite direction, suddenly turned right into Adbolton Road across Philip’s path as he was passing the junction. Philip tried to steer away from the car to avoid a crash, but despite his swift action, he was unable to avoid a collision. The force of the impact threw Philip from his bicycle and, as a result, he suffered soft tissue injuries to his face, lower rib cage and left knee as well as a musculo-ligamentus injury to his left shoulder. Philip’s road bike and cycling helmet were also damaged.

Police officers and paramedics were called to the scene. The motorist admitted to the police that his windscreen was icy and fogged up as he was turning right. The third party insurers failed to admit liability within the protocol period and continued to do so despite evidence produced in a police accident report clearly indicating that the motorist was entirely at fault.

Philip sought private physiotherapy treatment to expedite his recovery, following which his injuries resolved within approximately one month of the accident, leaving some residual discolouration to his skin. Following disclosure of medical evidence, the third party insurers finally agreed to deal with the claim and Philip’s damages claim was agreed on an amicable basis.
