A
cyclist has finally won his 3 year battle for compensation against the London Borough of Lambeth.
Peter Searle sustained injuries when he was thrown from his
bicycle whilst
cycling home from work in a cycle lane, not far from Waterloo Station. He hit an unlit plinth which projected into the
cycle path. The bollard usually on top of the plinth had been removed and had not been replaced.

Four months before the third anniversary of Peter’s accident, the representatives of LBL finally admitted primary liability and the case was settled on agreed terms.
Sue Bence, the Partner who conducted the case on behalf of Peter said:
‘Unfortunately in highway liability cases, more often than not a standard form denial of liability is issued by local authorities, their insurers and advisers. These cases are very difficult for Claimants to pursue given that the evidence to prove any breach of statutory duty or negligence, will be to a large extent, in the hands of the local authorities themselves.’
